Terms of Service

1. Acceptance

Upkeep Index is a service of Altshuler Family Holdings LLC ("we", "us", "our"). By joining our waitlist or using this site, you agree to these Terms of Service. You represent that you are at least 18 years old and have authority to enter into these terms. If you do not agree, please do not use the site.

2. The waitlist

This page currently offers a waitlist for early access to a maintenance-cost benchmarking subscription for property managers, co-op and condo boards, and building owners. Joining the waitlist means we will send you one email when the service launches. We do not sell your contact information. How we handle your information is described in our Privacy Policy.

Every marketing email we send includes a working unsubscribe link, and you may unsubscribe at any time. We may also send essential service communications (for example, receipts or notices of material term changes), which are not marketing emails.

3. Plans and pricing

When launched, planned annual plans are: Benchmark $199/year, Portfolio $499/year, Enterprise $1,999/year, in USD. We may change prices for new subscriptions. For renewals, we will notify you at least 30 days before your renewal date if the price changes; if you do not accept the new price, you may cancel before renewal without penalty.

4. Refunds

Annual plans are refundable within the first 30 days of purchase: if you request a refund within 30 days of the charge, we will return the full annual charge. To request a refund, email hello@upkeepindex.com within 30 days of the charge.

5. Cancellation

You may cancel at any time from your account settings or by emailing hello@upkeepindex.com. Annual plans remain active until the end of the paid term. We do not prorate partial years, except for the 30-day refund window in section 4.

6. Acceptable use

You agree not to misuse the service, including attempting to access other users' data, scraping or republishing the benchmark dataset, or using the service for any unlawful purpose. We may suspend or terminate accounts that violate this section.

7. Benchmark data and anonymity

Benchmarks are built from anonymized cost records. Vendor names, building names, and addresses are stripped before storage. We publish benchmarks only for market segments with enough contributing buildings to preserve anonymity, and we reserve the right to withhold any segment we believe is at risk of re-identification.

8. Intellectual property

The site, its content, and the benchmark dataset are owned by Altshuler Family Holdings LLC. Subscribers receive a limited, non-transferable license to use benchmark reports for their own internal business purposes. You may not republish, resell, or redistribute the dataset.

9. Third-party services

We use third-party service providers to operate the service, including email delivery, payment processing (Stripe), and hosting. Your information may be processed by these providers as described in our Privacy Policy.

10. Disclaimers

Benchmarks are informational only and do not constitute professional, legal, or financial advice. While we use reasonable efforts to keep benchmarks accurate, they are derived from third-party cost data and may contain errors. We do not guarantee any particular savings, negotiation outcome, or level of accuracy, and we are not responsible for decisions made in reliance on benchmarks.

11. Limitation of liability

To the maximum extent permitted by law, our total liability for any claim relating to the service is limited to the amount you paid us in the 12 months before the claim arose.

12. Changes to these terms

We may update these terms from time to time. Material changes will be posted on this page with a new "last updated" date.

13. Governing law

These Terms are governed by the laws of the State of New York, without regard to conflict-of-law principles. Any dispute will be resolved in the state or federal courts located in New York County, New York.
